Have A Visit – Terms & Conditions
Introduction
Welcome to Have A Visit. By downloading or using our app-based home exchange platform, you
agree to the following terms and conditions (“Terms”). These Terms apply only to the use of the
Have A Visit mobile application and related services, not to any website. Please read these Terms
carefully before using the service.
1. Description of the Service
Have A Visit is a digital platform that facilitates home exchanges between private individuals
(users). Through the app, users can create profiles, list their homes with descriptions and photos,
and connect with other users to arrange home exchange agreements. After each exchange, users
can rate and review each other to build trust and transparency on the platform. Have A Visit is not
a real estate agent or travel operator – we only provide a platform for users to communicate and
agree on exchanges. The service is intended for personal, non-commercial use by individuals
aged 18 or older, in Denmark and other EU countries. All use of the platform must comply with
these Terms and with applicable laws and regulations in your country.
2. User Account and Eligibility
To use Have A Visit, you must register an account with accurate, up-to-date information. Each user
may only create one personal account, and it must not be shared or transferred to others. Choose a secure password and keep your login details confidential. You are responsible for all activity on your account. If you suspect unauthorized use of your account, notify us immediately. You must
ensure you meet the eligibility criteria (e.g. age and personal use requirements). We reserve the
right to verify your identity or eligibility at any time.
• Account Information: You promise that all information you provide (profile details, home
description, etc.) is truthful, accurate, and kept updated. Misleading information may lead to suspension or termination of your account.
• Account Security: You are responsible for maintaining the security of your account
credentials. Have A Visit will never ask you for your password.
• One Account Rule: Your account is personal. Do not share your account with others or
allow anyone else to use your access. Violation of this rule may result in immediate suspension.
• Age Requirement: The platform is intended for users 18 years or older. By creating an account, you confirm that you meet this age requirement.
3. Payment, Subscription, and Cancellation Terms
3.1 Subscription Plans
Have A Visit operates on a subscription model. We offer subscription plans of various durations (e.g., 1 month, 3 months, 6 months, or 1 year). Subscription fees and billing cycles will be clearly displayed in the app at the time of purchase. All prices are shown in the applicable currency (e.g.,
DKK or EUR) and include applicable taxes unless stated otherwise.
3.2 Free Trial
New users may be offered a free trial period (e.g., 3 days). You will not be charged during the trial
period. Once the trial ends, the selected subscription plan will automatically activate, and the
payment method linked to your Apple or Google account will be charged—unless you cancel before the trial ends. You can manage or cancel your trial in your device’s subscription settings (Apple App Store or Google Play Store).
3.3 Payment Processing (Apple/Google)
All in-app purchases on Have A Visit are securely processed through the Apple App Store or Google Play Store. Have A Visit does not store or process your credit/debit card or payment details directly. By subscribing through the app, you authorize Apple or Google to charge your linked payment method according to their terms and conditions. 3.4 Auto-Renewal
Subscriptions purchased via Apple or Google are automatically renewed unless cancelled at least 24 hours before the end of the current period. The renewal will be for the same duration and at the current price unless stated otherwise. You can manage or cancel your subscription directly through your Apple ID or Google Play account settings.
3.5 Cancellation & Refunds
You can cancel your subscription at any time through your Apple or Google account settings.
Cancellations will take effect at the end of the current paid period. Refunds are handled solely by
Apple or Google in accordance with their respective refund policies. If you are an EU/EEA
consumer, you may have the legal right to withdraw from a subscription purchase within 14 days. However, once the service has been accessed (e.g., using app features), Apple or Google may deduct a proportionate amount or deny refunds according to applicable law. Please contact Apple or Google support to request a refund.
3.6 Price Changes
We reserve the right to change the prices of our subscription plans. In-app prices are managed by Apple and Google, and any price change will be communicated to you through the app stores. You will be given the opportunity to cancel your subscription before the new price takes effect. If you do
not cancel, the new price will be applied at the next billing cycle.
4. Using the Service – User Conduct and Obligations
When using Have A Visit, you agree to act responsibly and respect other users and their homes. You must comply with all platform rules and all applicable laws. By using the platform, you also confirm that you have the right to participate in home exchanges (for example, you either own the home or
have permission from your landlord or co-op to exchange it, and no law or contract forbids you
from doing so).
User Commitments:
• Honest Profile and Listings: Create and maintain a truthful profile and home listing. All
information about yourself and your property (location, size, amenities, availability, house
rules, etc.) must be accurate and not misleading. Do not omit any material facts that exchange partners should know (such as pet allergies, if a room is unusable, etc.).
• Quality of Home: Ensure your home is in a safe, clean, and acceptable condition for an
exchange. You should provide a reasonably hospitable environment as you would expect in return. All appliances and facilities should be in working order or clearly communicated if
not.
• Respect Other Homes: When you stay in someone else’s home through an exchange, treat
it with care and respect. Follow any reasonable house rules provided by the host (e.g. no
smoking, pet care instructions, etc.). Leave the home in the same condition as you found it,
aside from normal, minor tidiness issues. You are responsible for any damage you or your
party cause during your stay.
• Lawful Use: Do not use Have A Visit for any unlawful purpose or in violation of any laws. This includes respecting local regulations on short-term housing swaps or subletting. You are responsible for ensuring that home exchanging is allowed under your local laws, your
lease or homeowners’ association rules, and that you obtain any required permissions or
registrations.
• Prohibited Content and Behavior: You must not post or share any content that is illegal,
harmful, offensive, or infringes on anyone’s rights. This includes refraining from racist,
sexist, violent, hateful, or otherwise offensive language or images on your profile or in
communications. You must not harass, defraud, or mislead other users.
• No Commercial Use or Rentals: The platform is for non-commercial home swaps. You
may not use Have A Visit to rent out your home for money or conduct any commercial
lodging business, nor to exchange properties that are primarily commercial rentals.
Monetary transactions between users outside the platform’s intended use (such as asking
your exchange partner for money) are not allowed on a home exchange via Have A Visit.
• User Insurance: We strongly recommend that you have appropriate insurance coverage
for home exchanges. This may include homeowner’s or renter’s insurance, liability insurance, and travel insurance as relevant. It is your responsibility to verify that your insurance policies cover home exchange situations (both as host and guest) and to arrange
additional coverage if needed.
If you violate these guidelines or any other provision of these Terms, we may take action including removing content, suspending or terminating your account (see Section 11 on Termination), and/or notifying authorities if appropriate. Serious violations (such as illegal activity orendangering others) can result in immediate removal from the platform without refund of
subscription fees.
5. User-Generated Content and Intellectual Property
When you upload or post content on Have A Visit (such as home descriptions, photos, profile
information, reviews, messages, etc.), you retain ownership of your content, but you give us certain
rights to use it so we can operate the service:
• License to Use Content: By submitting or posting content on the platform, you grant Have
A Visit a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, modify (e.g. resize or crop photos), display, and distribute your content only for the purposes of operating, marketing, and improving the platform. For example, we may
display your home photos on our app or website, or in promotional materials to illustrate listings. We will never sell your content or use it outside the context of the Have A Visit service without your permission.
• Your Responsibilities for Content: You are solely responsible for all content you provide. You promise that you have all necessary rights to upload the content and to grant us the license above. This means, for instance, that you either own the copyright to your photos or
have permission from the photographer, and that your descriptions and information do not infringe any third-party’s rights (like copyrights, privacy, or data protection rights). Do not upload anything you do not have the right to use.
• Prohibited Content: Your content must not be unlawful, obscene, defamatory, threatening,
or otherwise objectionable. We may remove or disable content that we believe violates
these Terms or any law, or that infringes others’ rights. If you notice any content that you
believe infringes your intellectual property or other rights, please notify us.
• Platform Content: All rights in the Have A Visit platform itself (including our branding,
logo, design, software code, and collective content like the compilation of listings) belong to
us or our licensors. You may not copy, distribute, or create derivative works from our
platform content without our permission, except as allowed by law. “Have A Visit” and
associated logos are our trademarks and must not be used without consent.
• Third-Party Content: Content from other users or third parties on the platform is for your
personal use within the service. You may not use other users’ content outside of the Have A
Visit platform without permission. For example, you shouldn’t take someone’s home photos
from Have A Visit and publish them elsewhere.
6. Home Exchange Agreements and Digital Signatures
• Any home exchange agreement or arrangement you enter into via Have A Visit is solely
between you and the other user(s) involved. Have A Visit is not a party to your individual
home exchange contracts. We provide the platform to facilitate finding a match and
communicating, but the agreement to swap homes is made directly between users. This
means that users are responsible for negotiating and upholding the terms of theirexchange (such as travel dates, number of guests, house rules, etc.). We strongly encourage users to clearly communicate and perhaps even document their exchange terms (for example, through our messaging system or a written agreement).
• Future Digital Contract Feature: In the future, Have A Visit may introduce a feature that
allows users to create and digitally sign a home exchange agreement within the app. If and
when this feature is available, its purpose is to assist users in formalizing their
agreement. Even with digital signatures through our platform, Have A Visit remains a
facilitator and not a party to the contract. We do not guarantee the enforceability or legal
validity of any electronically signed agreement between users – that is subject to applicable
law between the users. Users should ensure any digitally signed contract meets their needs
and consider seeking legal advice if necessary. The use of a digital contract feature will be
optional and for the convenience of the users.
• No Endorsement or Verification: Have A Visit does not guarantee that any particular
exchange agreement is fair, safe, or will meet your expectations. We do not verify the legal
status of users’ properties (for example, whether they have permission to exchange) or the
conditions of the homes beyond user-submitted information. It is up to the users to vet each
other and the details of the exchange. We highly recommend thorough communication and
perhaps a mutual agreement (for example, on handling of keys, cleanliness, utility usage,
etc.) prior to exchange.
7. Ratings and Reviews
After a home exchange, users have the opportunity to leave a rating and review for their exchange partner. Reviews should be honest and fact-based, focusing on the exchange experience (such as the
condition of the home, cleanliness, communication, and how the guest treated your home). The purpose is to build trust and maintain high standards in the community.
• Fair Use of Reviews: You must not post false, misleading, or defamatory feedback. Do not
include personal insults, offensive language, or unrelated content in a review. Reviews should be written in accordance with our content guidelines and reflect genuine experiences.
• No Retaliation or Manipulation: Users should not harass or pressure each other over
reviews. For example, hosts cannot demand a positive review from guests, and guests
cannot threaten a bad review to get special treatment. Any attempt to manipulate the review system (such as trading positive reviews, posting fake reviews, or coordinating with others to unjustly impact a user’s reputation) is strictly prohibited.
• Platform Moderation: Have A Visit does not generally edit or censor reviews, as they are
user opinions. However, we reserve the right to remove or hide reviews that violate these
Terms or our policies (for example, a review containing hate speech or revealing someone’s
personal information). We may also intervene if a review is clearly about something beyond
the control of the user (e.g., a complaint about bad weather during the stay).
• Replying to Reviews: Users may have the opportunity to respond to reviews they receive
(for instance, a host can reply to a guest’s comments). Any responses must also adhere to
the conduct rules and be respectful and relevant.
8. Liability Disclaimers and Limitation of Liability
Have A Visit provides an online platform to connect users for home exchanges. We do not own,
inspect, or control the properties listed, and we do not guarantee the fulfillment or quality of
any home exchange. As such, our liability to you is limited as described below:
• No Guarantee of Home Conditions: We make no promises about the state or features of
any home offered on the platform. Descriptions and images are provided by users, and
while we require honesty, we cannot verify every detail. Any issues or discrepancies (for
example, if a home is not as described, not clean, or unavailable) are to be resolved between the exchanging users. Have A Visit is not responsible for addressing or compensating for
such issues.
• No Liability for Exchange Agreements: Any agreements or obligations arising from a
home exchange (such as costs of travel, arrangements for keys, or what happens if someone
cancels) are solely between the users. Have A Visit is not liable for any loss, damage,
costs, or disputes that result from agreements (or disagreements) between users. This
includes, but is not limited to, situations where one party fails to honor the exchange, last-
minute cancellations, or any breach of contract between users.
• Damage or Injury: You participate in home exchanges at your own risk. Have A Visit is not
responsible for any damage to property, theft, injury, or any other harm that occurs during
an exchange. Users are solely responsible for any damage or loss they cause to each
other’s property. We highly recommend that both hosts and guests have appropriate
insurance, as mentioned earlier. If any damage or incident occurs, it must be resolved by the
involved users (through communication, insurance claims, or legal means if necessary).
• Service Availability and Errors: We strive to keep the Have A Visit platform running smoothly, but we do not guarantee that the service will be uninterrupted or error-free at all times. There may be occasions when the app is unavailable (e.g., for maintenance or due to technical issues). We are not liable for any indirect harm or losses (like missed
opportunities for an exchange) due to platform downtime or technical malfunctions. Use of
the platform is provided “as is” and “as available.”
• No Warranties: To the fullest extent permitted by law, Have A Visit disclaims all warranties, express or implied, regarding the platform. We do not guarantee specific results from using the service, or that the platform will meet all your expectations. For example, we cannot guarantee you will successfully find an exchange or that another user will be a perfect match.
• Limitation of Liability: To the extent allowed by law, if we are found liable for any claim
arising from these Terms or the use of the platform, our liability to any user is limited to the
amount of fees the user has paid us in the past 12 months (or, if greater, DKK 500/EUR 70).
We will not be liable for any indirect, consequential, punitive, or special damages (such as
loss of enjoyment, emotional distress, lost data, lost profits, etc.). This limitation
does not exclude or limit any liability that cannot be limited by law, such as liability for
gross negligence, intentional misconduct, or personal injury caused by our proven
negligence.
9. Indemnification (Hold Harmless)
• English: You agree to indemnify and hold harmless Have A Visit, its owners, employees,
and affiliates, from any claim, demand, loss, or damage (including reasonable attorney’s
fees) arising out of or related to: (a) your breach of these Terms or violation of any law or
rights of a third party; (b) any content you provide on the platform (for example, if you
posted photos you didn’t have rights to, or provided false information, and it causes a
dispute); or (c) your home exchange agreements or interactions with other users (for
example, if another user sues Have A Visit because of something you did, such as property damage or personal injury you caused). This means that if someone else (including another user) brings a claim against Have A Visit for something that you are responsible for, you will be responsible for the costs and damages. We will notify you of any such claim and, if we
choose, allow you to assist in defending it, but we reserve the right to handle our legal
defense as needed.
• (Note: This indemnity does not apply if you are a consumer in an EU country and such an
indemnity is prohibited by law. In such cases, you will only be held responsible to the extent
allowed by applicable law.)
10. Suspension and Termination of Account
10.1 By User (Cancellation): You have the right to stop using Have A Visit and may delete your
account at any time through the app settings or by contacting us. If you have an active subscription
and you choose to delete your account or cancel the service, the cancellation will be effective at
the end of the current subscription period (see Section 3 for details on subscription cancellation). After account deletion, you will no longer have access to the platform or your account
data (so make sure to save any information you need beforehand). Deleting your account does not
automatically entitle you to a refund of any paid fees except as described in Section 3 or required by law.
10.2 By Have A Visit (Suspension or Termination): We reserve the right to suspend or terminate
your account at our discretion if we believe you have violated these Terms, misused the service, or engaged in behavior we deem harmful or illegal (for example, fraud, harassment, listing a property you have no right to exchange, posting illegal content, etc.). In most cases, we will send you a warning or ask you to correct an issue before terminating an account. However, for serious violations or unlawful activity, we may suspend/terminate immediately without notice.
• If your account is suspended, you will temporarily lose access to the platform (you may be
prevented from logging in, messaging, or arranging new exchanges) until we resolve the
issue. We will inform you of the reason for suspension and what steps (if any) you can take
to restore your account.
• If your account is terminated by us, this means permanent closure of your account. You
will be notified that your account is closed. You may also be banned from creating a new account. If we terminate due to your violation of Terms or misconduct, you are notentitled to any refund of subscription fees for the remaining period. If termination was in error or without cause, we will refund any prepaid amounts on a pro-rata basis.
• We also reserve the right to remove or modify any content you have posted on the platform
if we terminate or suspend your account.
10.3 Effect of Termination: Upon termination of your account (whether by you or us), your right
to use the Have A Visit app and platform ceases immediately. Any content or data associated with
your account may be deleted or become inaccessible (except as otherwise required by law or our
Privacy Policy). However, reviews or content you contributed may remain on the platform (for
example, reviews you gave others might still be visible, tied to an anonymous “Former User” label).
We are not liable to you for compensation or damages due to terminating your account in line with these Terms.
11. Privacy and Data Protection
Your privacy is important to us. Any personal data you provide to Have A Visit (such as your name,
contact information, profile details, and any content that may contain personal data) will be
handled in accordance with applicable data protection laws, including the EU General Data
Protection Regulation (GDPR).
• We will use your data to provide and improve the service, to communicate with you, and as
otherwise described in our Privacy Policy (please refer to our Privacy Policy for detailed information on how we collect, use, store, and protect your personal data). By agreeing to these Terms, you also acknowledge our Privacy Policy.
• User Rights (GDPR): If you are in the EU/EEA (or where applicable by similar laws), you
have certain rights regarding your personal data. These include the right to access data we
hold about you, to have inaccurate data corrected or updated, to have your data deleted, and to object or restrict certain processing of your data. You can exercise these rights by
contacting us at any time. For example, you can request a copy of your personal information
or ask us to delete your account and associated data.
• Content Visibility: Keep in mind that content you post on your profile or listings (like your
first name, general location, home description, photos, exchange reviews) may be visible to
other users of the platform and possibly the public (if we showcase listings publicly). Do not
include personal contact information (like your address, phone, email) in public profile
fields to protect your privacy – the platform will facilitate contact through the app without
revealing sensitive details until you choose to share them with an exchange partner.
• Communication: We may send you service-related communications (e.g., notifications about exchange requests, account updates, or changes to terms). We may also send promotional communications if you have agreed to them, but you can opt out of marketing
emails at any time.
• Security: We implement appropriate technical and organizational measures to protect your data against unauthorized access, loss, or misuse. However, no system is 100% secure, so you should also be careful with your own account security (see Section 2 on Account Security).For more details, please refer to the Have A Visit Privacy Policy. By using the platform, you consent to the collection and use of information as outlined there.
12. Changes to These Terms
Have A Visit may update or modify these Terms from time to time (for example, to reflect changes
in our services, legal requirements, or business practices). When we make changes, we will notify users in an appropriate manner – for instance, by posting the updated Terms in the app and updating the “last revised” date, or by sending a notification/email if the changes are significant. It is your responsibility to review any updated Terms. By continuing to use the platform after updated Terms have been posted and come into effect, you are agreeing to the changes. If you do not agree to the revised Terms, you should stop using the platform and, if applicable, cancel your
subscription or delete your account. No change will retroactively affect any dispute between you and us that arose prior to the date of the update, and changes will not shorten the term of any subscription you have already paid for without your consent.
13. Governing Law and Dispute Resolution
These Terms and any use of the Have A Visit platform are governed by the laws of Denmark. This means that the interpretation and enforcement of these Terms will follow Danish law. However, if
you use the platform as a consumer in another EU country, you will not be deprived of any
protection afforded to you by the mandatory consumer laws of your country of residence. In other
words, you may have certain rights under your local laws in addition to those under Danish law, and those rights are preserved. Jurisdiction: Any dispute, controversy, or claim arising out of or relating to these Terms or your use of Have A Visit that cannot be resolved amicably through our customer service shall be subject to the jurisdiction of the courts of Denmark. If you are a consumer domiciled in the EU, you may also be entitled to pursue claims in your home country’s courts under applicable consumer protection laws.
Dispute Resolution and Complaints: We encourage you to contact us first to resolve any issue. You can reach out via the contact information in Section 14, and we will do our best to address your concerns. If we cannot resolve a dispute, you have a few formal options:
• Formal Legal Proceedings: You may bring a claim against Have A Visit in the Danish courts
(or potentially in the courts of your EU home country, as noted above).
• Alternative Dispute Resolution: As a consumer, you also have the option to use alternative dispute resolution methods. In the EU, you can file a complaint through the EU Online Dispute Resolution (ODR) platform(available at ec.europa.eu/consumers/odr).The ODR platform can help facilitate a resolution with us extrajudicially.
Please note: submitting a complaint via ODR is not obligatory and it does not prejudice your right to seek
relief through the courts.
• Local Consumer Authorities: Depending on your country, you might also seek advice or
help from a local consumer protection agency or ombudsmand.

Acceptance / Accept: By using the Have A Visit app, you acknowledge that you have read,
understood, and agree to these Terms & Conditions in their entirety. If you do not agree with any part of these terms, you should not use the platform.
